Terms of Service

1.Acceptance

These Terms of Service (“Terms”) constitute a legally binding agreement between you and PTCC governing your access to and use of the PTCC platform at ptcc.io (the “Platform”). By registering for an account or accessing the Platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2.Description of Service

PTCC provides an online platform for personal trainers to develop and certify their ability to conduct effective client sales consultations. The Platform includes:

• Video training modules covering a structured consultation framework.
• Practice sessions — live, voice-based simulations against an automated prospect, with immediate automated feedback. Practice sessions do not count toward certification.
• Certification sessions — graded assessments scored against a standardised rubric. A passing score results in a PTCC Certificate valid for the period specified at the time of issue.
• Organisation management tools — for gym owners and managers to track team progress, session history, and certification status.

We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time with reasonable notice.

3.Accounts & Organisations

You must provide accurate, current information when registering and keep your account details up to date. You are responsible for all activity under your account and must notify us immediately if you believe your account has been compromised.

Organisation administrators may invite team members, view member progress and scores, and manage seat allocations. Administrators are responsible for ensuring that the individuals they add have agreed to these Terms. Members may not be added to an organisation without their knowledge.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with advance notice where reasonably practicable.

4.Recording & Assessment Consent

Each practice and certification session involves a live voice interaction conducted through your browser. By starting a session, you acknowledge and consent to the following:

• Audio capture. Your device microphone will be accessed via the browser WebRTC API for the duration of the session. You will receive a browser-level permission prompt before this occurs.
• Recording and storage. The session audio will be recorded, transmitted over an encrypted connection, and stored in Cloudflare R2 object storage as a compressed audio file. Storage is subject to the retention schedule in our Privacy Policy.
• Automated evaluation. Session audio will be transcribed and evaluated by our automated scoring system against a standardised rubric. The system produces a numerical score and criterion-level breakdown. This evaluation determines your pass/fail result for certification sessions.
• Organisational access. If your account is associated with an organisation, the designated administrator will have access to your session scores and transcript summaries, as described in our Privacy Policy.

You may withdraw consent at any time by not participating in further sessions. Withdrawal does not affect the retention of recordings from sessions already completed, which remain subject to the schedules stated in our Privacy Policy.

5.Certification Standards

A PTCC Certificate is awarded when a user achieves a score of 80% or above on a certification session assessed against the published rubric. Certificates are personal to the individual named and are not transferable.

Scores are determined by our automated assessment system. If you believe a score contains a technical error — for example, due to an audio processing failure — you may submit a dispute request to support@ptcc.io within 30 days of the session. We will review the session recording and scoring data and respond within 10 business days.

Disagreement with the scoring criteria or rubric weightings does not constitute grounds for a dispute. The published rubric is the definitive standard.

6.Payments & Refunds

Fees for certification sessions, training module access, and organisation seat plans are displayed at the point of purchase and are denominated in US dollars unless otherwise stated. All payments are processed by Stripe.

Refund policy. If you experience a verified technical failure during a certification session — such as an audio processing error that prevents a valid score from being produced — we will issue a replacement session credit at no charge. Refund requests for reasons other than verified platform failures are evaluated on a case-by-case basis and must be submitted within 14 days of the session date.

Session credits are non-transferable, have no cash value, and expire 12 months from the date of issue unless otherwise specified.

7.Acceptable Use

You agree not to:

• Use the Platform to transmit content that is unlawful, harmful, or fraudulent.
• Attempt to circumvent or manipulate the automated scoring system, including by pre-scripting responses designed to exploit rubric patterns rather than demonstrate genuine consultation ability.
• Share your account credentials or allow another person to complete a session on your behalf.
• Reverse-engineer, decompile, or attempt to extract the source code or rubric algorithms of the Platform.
• Use automated tools to interact with the Platform in a manner not intended for human use.
• Reproduce, distribute, or create derivative works from Platform content — including session transcripts, scoring reports, or training materials — without our express written permission.

Violation of these terms may result in immediate account suspension without refund.

8.Intellectual Property

All Platform content — including training modules, rubric frameworks, scoring algorithms, written copy, and software — is owned by or licensed to PTCC and is protected by applicable intellectual property law.

You retain ownership of the audio recordings of your own sessions. By using the Platform, you grant PTCC a limited, non-exclusive licence to process, store, and evaluate those recordings solely for the purpose of providing the assessment service described in these Terms.

PTCC does not claim ownership of your session audio and will not use it to train machine-learning models operated by or on behalf of third parties.

9.Disclaimers

The Platform is provided “as is” and “as available.” To the maximum extent permitted by law, PTCC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

PTCC does not warrant that the Platform will be error-free, uninterrupted, or that automated evaluation scores will be free from inaccuracy in all cases. The automated assessment system evaluates language and structure — it does not assess all dimensions of in-person sales skill and should be treated as one tool in a broader development programme.

Holding a PTCC Certificate does not guarantee employment outcomes or any specific commercial result.

10.Limitation of Liability

To the maximum extent permitted by applicable law, PTCC and its directors, employees, and service providers will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of or inability to use the Platform.

Our total aggregate liability to you for any claim arising under these Terms will not exceed the greater of (a) the amount you paid to PTCC in the 12 months prior to the event giving rise to the claim, or (b) one hundred US dollars (USD 100).

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, death, or personal injury caused by our negligence.

11.Governing Law & Modifications

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Your continued use of the Platform after that notice constitutes acceptance of the revised Terms.
